MAINTENANCE OF PUBLIC PROSECUTION
Prosecutors maintain public prosecution in the courts of the first instance, courts of appeal and courts of cassation.
Prosecutors working in the Division of Public Prosecution of Prosecutor General’s Office usually participate in the Court of Appeals when complaints on the application of procedural coercive measures prescribed by law in the criminal cases the pre-trial investigation in which has been completed and the case has been handed over to court, are being examined.
Activity of Public Prosecution Division covers the following main fields:

maintaining public prosecution in the cases examined in the Court of Appeals of Lithuania;

maintaining public prosecution in the cases examined in cassation procedure in the Supreme Court of Lithuania;
-
participation in examination of complaints on application of procedural coercive measures prescribed by law in the criminal cases the pre-trial investigation in which has been completed and the case has been handed over to court;
-
participation in the Supreme Court of Lithuania, in the procedure of resumption of the case due to the newly discovered circumstances, participation in examination of resumed criminal cases which were resumed due to application of obviously improper law or decisions made by the European Human Rights Court;
-
supervision of submission of the judgements for enforcement and enforcement thereof; controlling participation of prosecutors in the court sessions concerning the amendment of the convicts’ sentence, or length and conditions thereof;
-
inspection of legitimacy of valid judgements and decisions in the cases which were heard by regional and district courts.
Furthermore, prosecutors of Public Prosecution Division audit the work of prosecutors maintaining public prosecution who work in the territorial prosecutor’s offices, and provide assistance on the spot. If needed, prosecutors of the Division maintain public prosecution in any Lithuanian court of the first instance.
Public Prosecution Division organizes its activities in accordance with zones; particular regional prosecutor’s offices and district prosecutor’s offices subordinate to them are allocated to each prosecutor.
In addition, Public Prosecution Division works following the principle of the subject; prosecutors specialize in particular issues of criminal law and criminal procedure law as appointed to them.
Besides, Prosecutors analyze courts practice and prosecutor work practice, prepare recommendations about application of laws, examine complaints covered by the competence of the Division and contribute to the preparation of draft laws.
In addition to the Chief Prosecutor and his Deputy, there are eighteen prosecutors, three assistants to the chief prosecutor and one chief specialist working in the Public Prosecution Division.

Prosecutors of the Division keep in contact with Department of Prisons under the Ministry of Justice and offices subordinate to the Department, deal with issues concerning the submission of judgements for enforcement and enforcement thereof, amendment of the length and conditions of the sentence, as well as receives and analyzes relevant statistical information.
