Upon properly examining and assessing the data obtained in pursuance of clarification of circumstances of the event, Prosecutor of Vilnius District Prosecutor's Office has confirmed that the decision by the pre-trial investigation officer of Vilnius City Police Unit No III under Vilnius County Police Headquarters – whereby launching of a pre-trial investigation on the basis of the report by a foreign woman who attended the Rammstein concert organised in the capital (Vilnius) – was legitimate and well-grounded. The decision to refuse to launch the pre-trial investigation into the facts was made upon concluding that there was no conduct bearing the constituent elements of a criminal offence or a misdemeanour present at the time of the facts.
The circumstances referred to in the said report have been linked to a number of criminal offences related to infliction of physical pain, sexual violence, coercion to use narcotic or psychotropic substances and robbery which were allegedly committed by Rammstein band members during their concert held on 22 May 2023 in Vingis Park of Vilnius.
In order to clarify the circumstances stated in the report, pre-trial investigation officers of Vilnius County Police Headquarters carried out necessary procedural measures, namely: the applicant and the witness were interrogated, data and documents relevant to the investigation analysed.
In the decision to refuse to launch a pre-trial investigation the conclusion was made that, in the light of the totality of data obtained during the clarification of relevant circumstances, no objective factual evidence were determined which would substantiate the fact that the applicant had been indeed subjected to physical violence or mental coercion, or any forcible acts of a sexual nature, or that she had been made to use narcotic substances, or robbed.
The decision made by the pre-trial investigation officer to refuse to launch the pre-trial investigation into these facts may be appealed against in accordance with the procedure prescribed by the Criminal Procedure Code of the Republic of Lithuania.
